PREMIUM COMPETITIONS

1. Qualifying Persons

 

1.1 Dream Whiskies Ltd (‘Dream Whiskies’, 'Promoter', 'our(s)') operate competitions – skilled prize competitions resulting in the allocation of prizes in accordance with these Terms and Conditions on the website www.dreamwhiskies.com (the 'Website') - (the 'Competition(s)').

 

1.2 The Competitions are open to all persons aged 18 and over in the UK and the age at which it is legal to consume, purchase and own alcohol (over 24%abv) in their country of residence, region or state excluding the Promoter's employees or members of their immediate family, agents or any other person who is connected with the creation or administration of our Competitions.

1.3 Where it is legal to consume, purchase and own alcohol (over 24%abv) in a person's country of residence, region or state but is not legal or permitted to ship alcohol from the Uk to a person's country of residence, region or state, condition 6.3 of these terms and conditions comes in to effect.

 

2. Legal Undertaking

 

2.1 By entering a Competition the entrant ('Entrant', 'you', 'your(s)') will be deemed to have legal capacity to do so, you will have read and understood these Terms and Conditions and you will be bound by them and by any other requirements set out in any related promotional material.

 

2.2 These Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.

 

2.3 In the event that you participate in a Competition online via the Website, and by accepting these Terms and Conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

 

3. Competition Entry

 

3.1 These Competitions may be entered online via the Website. There are two categories of Competitions: Premium Competitions and Free-Play Competitions. One or more Competitions may be operated at the same time and each Competition will have specific prize options.

 

3.2 Availability and pricing of Competitions and tickets is at the discretion of the Promoter and will be specified at the point of sale on the Website.  Pricing will not be applied retrospectively to orders already completed. 

3.3 Free bonus entries apply only to the 5 entry price categories only and appear as a 6th entry.

3.4 When playing a Premium Competition online via the Website, follow the on-screen instructions to:

(a)You will need to check your details carefully and confirm that you have read and understood the declaration and the Competition Terms and Conditions;

(b) for each Premium Competition Ticket you will need to complete a Guess the Total challenge onscreen, which shall operate as follows:

(i) you will be provided with a question where you are required to calculate the answer as a whole number with the goal being to calculate (as closely as possible) the exact numerical answer without going over;

(ii) using all the information shown provided (this will include photographs and additional clues) use your skill and judgement to correctly calculate the numerical answer without going over (exceeding the correct numerical answer);

(iii) click on the entry panel, enter your name, email address and select which entry option you desire with the options being 1, 2, 3, 4 or 5 entries. In selecting the '5 entry' option, a bonus sixth (free entry) will be added to the package. 

(iv) insert your answer(s) in to the text boxes provided and then click the check-out (Pay & Enter Now) button where you will be redirect to a payment screen. Your entry (entries) will be registered after you have completed the payment transaction and you will receive a confirmation email confirming the full details of the transaction inclusive of confirmation of your entry details.

Please note that when entering online you will not be deemed entered into the Competition until we confirm your Entr(y)(ies) order back to you by email. 

 

3.5 The Promoter reserves the right to refuse or disqualify any incomplete Entries if it has reasonable grounds for believing that an Entrant has contravened any of these Terms and Conditions.

 

3.6 To the extent permitted by applicable law, all Entries become our property and will not be returned.

 

3.7 Dream Whiskies Premium Competitions: Entries (tickets) are limited to a maximum of 6 (5 plus bones entry) per person, per session. Abuse of this limit will not be tolerated and if the Promoter has reasonable grounds to believe that an individual is exceeding this limit, for example by entering a Competition using multiple accounts, it reserves the right at its sole discretion to void any entry (entries) associated. In addition, if any person using a single account exceeds 150 entries (not including any Free Bonus entries) in a single Competition for any reason, the Promoter reserves the right at its sole discretion, to void any entries without notice firstly on a chronological basis with respect to orders, and then on a sequential basis with respect to entry references contained within an order, so as to void any entries exceeding the first 5 (plus 1 free bonus) paid entries entered into the Competition.

4. Dream Whiskies Account

4.1 Until further notice, entrants are not required to create a Dream Whiskies account to play Premium competitions. Each competition entry completed is processed as a stand-alone transaction.

5 Competition Judgement

 

5.1 Dream Whiskies Premium Competitions: The correct numerical answer to the question will be announced at the close of the competition and will be supported by documented or visual proof. In the case of a Guess the Weight competition, the promoter will take photographic and video records of the question item, timed stamped prior to the competition commencing. The equipment used to ascertain the weight will correspond with any clues provided as part of the competition and will be the definitive method of measurement used to determine the correct answer for the competition in question. In the case of Guess the Total competitions, the promoter will provide photographic and video evidence in support of the correct answer total, time stamped prior to the commencement of the competition.

 

5.2 Within forty eight (48) hours of the end of the respective Premium Competition, correct numerical answer will be computed against the database of entries to mathematically calculate which of the valid and eligible Entries received by the Promoter is closest to the correct answer (without exceeding the correct answer), and therefore the winning Entrant (the 'Prize Winner') of the prize. The Prize Winner will be the person who correctly identifies, or if no one is correct, who is closest to, the correct numerical answer (without exceeding the correct numerical answer). In the event that there are two or more Entrants with valid and eligible Entries that are equally close to or exactly match the correct numerical answer (each a 'Tie Break Entry'), the entrants to whom such Tie Break Entries belong, identified by their entry (the 'Tie Break Entrants') will participate in a tie break mechanic to determine the Prize Winner for such Competition as follows:

(a) Tie Break Scenario 1 – in the event that each of the Tie Break Entrants has made multiple Entries to the Competition: in Tie Break Scenario 1, the other Entries to the Competition made by each Tie Break Entrant using the same entry package as their respective Tie Break Entry will be used to determine the Prize Winner as follows - the First Prize Winner will be determined by calculating the next closest Entry to the correct answer (excluding the Tie Break Entry) ('TB1 Entries') made by each Tie Break Entrant in that Competition ('Tie Break 1'). In the event that a single Entrant has more than one Entry involved in a Tie Break, each Entry will be considered individually and eligible to be the next closest entry to each other. In the event that Tie Break 1 results in a tie break, the Tie Break 1 process will be repeated until there are no more TB1 Entries to judge. For the avoidance of doubt, it is not necessary for the Tie Break Entrants to have made the same number of Entries. However, judging under Tie Break 1 will cease when there are no longer sufficient TB1 Entries to compare. For example, if the first Tie Break Entrant has made a total of 5 Entries and the second Tie Break Entrant has made a total of 10 Entries, judging will cease after a maximum of 4 rounds of Tie Break 1 because the first Tie Break Entrant has no further TB1 Entries to compare. If a winner cannot be determined by using the Tie Break 1 process, such tied entrants ('TB1 Tie Break Entrants') will participate in Tie Break 2 (defined in 5.3(b) below);

 

(b) Tie Break Scenario 2 – in the event that one or more of the Tie Break Entrants has only made one (1) Entry to the Competition or in the event that Tie Break 1 results in a tie break: the Tie Break Entrants or the TB1 Tie Break Entrants (as relevant) will be asked to take part in another Guess the Total challenge using a new question in order to determine a single Prize Winner (the 'Tie Break 2'). Tie Break 2 will be entered and judged on the same terms as the original Guess the Total Challenge and there will be no additional payment due. In the event that Tie Break 2 results in a tie break, the Tie Break 2 process will be repeated with the respective tied Entrants until there is a single Prize Winner. In the event that a single Entrant has more than one Entry involved in a Tie Break, each Entry will be eligible for a separate Tie Break 2 Entry. If the Promoter is unable to contact one or more of the Tie Break Entrants or the TB1 Tie Break Entrants (as relevant) for Tie Break 2, within three (3) days (which may be extended at the sole discretion of the Promoter) of identifying such Tie Break Entrants (or TB1 Tie Break Entrants as relevant), Tie Break 2 will be concluded without that particular Tie Break Entrant or the TB1 Tie Break Entrant (as relevant). All Tie Break Entrants, including those that we were unable to contact will be automatically allocated a tie break prize in accordance with rule 7.1(j). Tie Break 1 and Tie Break 2, together referred to as "Tie Break"

5.3 The competitions will run for a stated minimum time period with the caveat being that a minimum number of 2000 entries must be achieved. The competition can have time added on up to 4 times maximum in the event that the minimum stated number of entries has not been reached. If the competition has not reached it's minimum entry number after the 4th timer running out, then the prize that will be awarded will be as follows:

70% cash prize of the amount of money taken by Dream Whiskies during this competition from the entries made or a whisky prize with a retail value of 70% of money taken by Dream Whiskies during this competition from the entries made. 

6. Winner's Details

 

6.1 The Winners will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorisation to use it, before any prize will be paid or delivered. Any failure to meet these obligations may result in the Winner being disqualified and the Promoter choosing an alternate winner.

 

6.2 All Winners will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition. Following receipt and verification of the details requested above by the Promoter, the Winners will be contacted in order to make arrangements for delivery of the prize. 

 

6.3 In the event that the winner resides in a country, region or state that does not permit the shipping of alcohol (above 24%abv) in to that country, region or state, the promoter will instead offer the following alternatives.

(a) The promoter will endeavour to make an international purchase of the advertised prize within the winner's country, region or state and have it delivered internally with said country, region or state.

(b) If the advertised product is not available for international purchase within the winner's country region or state, the promoter will offer an alternative whisky prize of the same (or higher) value that is available for international purchase and shipping within the winner's country, region or state.

(c) If it is not possible to achieve either of 6.3 (a) or (b), the promoter will offer the full retail value (based on current UK retail price in sterling GBP) of the prize in the form of a cash transfer to the winner's chosen bank account.

6.4 The alternative prize arrangement (6.3 above) as with all other terms and conditions are dependent upon condition 1.2 (above) being satisfied and adhered to.

7 Winners' Personal Data

 

7.1 Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with rule 6.2, unless prohibited by law.

 

7.2 By entering a Competition, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (save for reasonable travel expenses) and as required by the Promoter if you are declared a Winner.

 

8. Limits of Liability

 

8.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.

 

9. Electronic Communications

 

9.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.

 

9.2 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition. The Promoter may in its sole discretion cancel, terminate, modify or suspend a Competition, or invalidate any affected entries. In the event that the Promoter closes a Competition early, the Winner may be selected from all valid and eligible Entries received by the Promoter prior to the date of closure, except that the Promoter reserves the right, at its sole discretion, to close a Competition early without selecting a Winner. In the event that a Competition is closed without selecting a Winner, the Promoter will give all entrants Dream Whiskies Premium Credit to enable them to replay equivalent entries in a subsequent competition.

9.3 The Promoter will set, for each premium competition a timed deadline for the competition close in addition to a minimum number of entries required. The minimum number representing a break-even figure to cover the costs of running and promoting the competition in addition to covering the cost and delivery of the prize. This minimum entry number will differ for each competition depending upon the value of the prize (UK full retail sterling GBP) and will be published on the competition page. In the event that the number of entries for the competition has not reached the minimum requirement, the promoter reserves the right to extend the life of the competition until the stated minimum entry number has been reached, at which point the competition will close and a winner will be selected.

 

9.4 The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the entry details recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event. Competition results  may be checked at any time by accessing the past-winners page on the Dream Whiskies website.

 

10. Data Protection Notice

 

10.1 Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable.

In order to process, record and use your personal data the Promoter may disclose it to

(i) any credit card company whose name you give;

(ii) any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you;

(iii) any person to whom the Promoter proposes to transfer its business or any part of it;

(iv) comply with any legal or regulatory requirement of the Promoter in any country; and

(v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.

 

15. Promoter

A list of winners and their home town will be available for one (1) month after the end of each Competition by sending an email to the Promoter.

Free-Play Competitions:

 

1.1 Dream Whiskies run monthly, free-to-enter competitions where players have the opportunity to win a prize of whisky (or whiskey) of a premium standard.

1.2 Prizes will be in the form of a bottle (or bottles) of whisky of stated volume, age, abv, brand. Additionally, prizes may be offered in the form of other whisky related products or services.

1.3 Monthly prizes will be announced by Dream Whiskies at the opening of each competition, stating the whisky brand, vintage (if relevant) and value.

1.4 Competitions run for a period of one calendar month, from 00:00 GMT on the first of the month through to 00:00 GMT on the final day of the month. 

2 Entry criteria:

2.1 Entrants must be of legal drinking age for their country, state or region and the ownership and consumption of alcohol in the form of sprits (over 24% abv) must be legal in the entrant's country, state or region.

2.3 Entrants are permitted to enter the competition on as many occasions as the competition software allows.

2.4 Entrants are not permitted to enter multiple times from separate accounts. This will render all entries for that particular entrant invalid.

2.5 To access the competition, entrants are required to sign-up to the Dream Whiskies Newsletter database. This data is used to provide e-mail newsletters promoting Dream Whiskies competitions, blogs, videos and other Dream Whiskies related information and opportunities.

2.6 Entrants that subscribe and then subsequently unsubscribe from the Dream Whiskies database, prior to the close of the competition that they subscribed to, will render all of their competition entries invalid.

3 Winners Selection: 

3.1 Winners of the main competition prize are selected at random using the 'winner selection' software built in to the competition software.

3.2 Winners of bonus prizes are selected according to the criteria laid out in bonus prize announcement emails or on the Dream Whiskies website.

3.3 Winners of the main prize and bonus prizes will be notified directly by the e-mail address that they used to sign-up to the Dream Whiskies newsletter database.

 

3.4 Dream Whiskies reserve the right to change the main advertised prize for a similar prize of similar value at any time and without notice.

3.5 Winners must provide proof of age and identity in the form of passport, official ID card, photo identification, or other official documentation as part of the entry ratification process. Failure to provide the aforementioned proof will result in the entrant's winning entry be rendered invalid, at which stage Dream Whiskies will draw another winner.

3.6 Winners must provide all proof of age and identity within 1 calendar month of the close of the competition that they have been selected as the winner. Failure to do so will render the winning entry invalid at which stage Dream Whiskies will draw another winner.

3.7 In the event of Dream Whiskies not receiving a reply from the winner to the winner's notification email, Dream Whiskies will resend the notification on a weekly basis for the period of one calendar month. In the event, after 1 calendar month, Dream Whiskies has received no response to the winner's notification email, the winning entry will be rendered invalid and Dream Whiskies will draw another winner.

3.8 Winners of all prizes, including the main competition prize and bonus prizes must agree to pose for (or provide) photographs of themselves alongside the prize (or being presented with the prize) for use as promotional material by Dream Whiskies on the Dream Whiskies website, social media and any other form of Dream Whiskies competition promotion. Failure to agree to this condition will result in the winning entry being rendered invalid, at which stage Dream Whiskies will draw another winner.

3.9 All prizes will either be shipped and delivered by courier or delivered in person by a representative of Dream Whiskies. When sent by courier, prizes will require a signature of acceptance by the recipient.

3.10 All decisions relating to winners, invalid entries, re-draws, etc are taken by Dream Whiskies and are final.
